A FENCE blocking public access to a Wellington path used for decades, which was erected without planning permission, can stay.

The decision, taken by Taunton Deane planning committee, has been described as 'strange' by local councillors and residents.

A row erupted in September when pensioners Robert and Margaret Spurway declared their intention to erect the fence across a path petween Millstream Gardens and Burchills Hill, which runs past their bungalow.

Local protesters said the path had been in use for many years and its closure forced people to use a dangerous alternative route along Milverton Road.

Wellington town Cllr Andrew Govier said: "I am disappointed by this decision but not altogether surprised.

"The Deane council planning seems to take a strange view of issues in Wellington.

"The planning committee agreed with the officers' recommendation not to take any action because although the residents had refused to apply for planning permission, they were likely to get it if they did."
